These Terms and Conditions govern your use of our platform and services, including but not limited to bulk SMS, transactional SMS, promotional SMS, voice SMS, OTP SMS, and related messaging services. By accessing or using our website, you agree to comply with the terms set forth below.

1. Eligibility & Account Responsibility

By using our services, you confirm that you are at least 18 years old and legally capable of entering into binding agreements. You are solely responsible for maintaining the confidentiality of your account credentials and all activities under your account.

2. Compliance with TRAI and Government Regulations

Bulk SMS Solutions strictly adheres to the Telecom Regulatory Authority of India (TRAI) and Department of Telecommunications (DoT) guidelines. As a user, you are required to comply with the following:

a) DLT Registration (Mandatory)

Before sending any kind of SMS—transactional, promotional, or OTP-based—you must register with an authorized Distributed Ledger Technology (DLT) platform as per TRAI rules.

• You must register your sender ID (header)

• Submit SMS templates for approval

• Only use approved templates and headers

Failure to comply with these regulations may result in message delivery failures or legal consequences. You are solely responsible for the accuracy of the information submitted during the DLT registration process.

b) DND Compliance

Promotional SMS cannot be sent to numbers registered under Do Not Disturb (DND). Our platform blocks such deliveries automatically. Any attempt to bypass this mechanism is strictly prohibited.

c) Content Restrictions

You agree not to use our services to send:

• Fraudulent or misleading messages

• Adult or pornographic content

• Hate speech, threats, or abusive material

• Unapproved political, financial, or religious messaging

Any violation may lead to immediate suspension or termination of your account.

3. User Obligations

• You agree to use the platform only for lawful purposes.

• You will not misuse the system to send spam or unsolicited messages.

• You are responsible for maintaining your DLT compliance records.

• You must ensure that recipients have opted in to receive your messages.

4. Service Usage and Delivery

While we ensure high delivery rates, SMS delivery depends on multiple external factors including the recipient’s mobile operator and handset. We are not liable for delays or failures beyond our control.

We do not guarantee the delivery of messages to numbers with issues like:

• Switched-off phones

• Poor network coverage

• Incorrect numbers

5. Payment Terms

• All payments are to be made in advance.

• No refunds will be made for delivered SMS.

• Refunds are available only as per our Refund Policy for unused SMS credits.

6. Account Suspension and Termination

We reserve the right to suspend or terminate any account that:

• Violates these terms or applicable laws

• Uses our platform for abusive or illegal activities

• Fails to comply with TRAI/DOT regulations

7. Limitation of Liability

Under no circumstances shall Bulk SMS Solutions be held liable for any loss or damage (direct or indirect) caused by:

• Message delivery delays

• Loss of data

• Service interruptions

• Acts of third-party providers

8. Privacy and Data Protection

All user data is handled as per our Privacy Policy. We do not share your personal information with third parties, except as required by law or for providing core services.

9. Amendments

We reserve the right to update these terms at any time. It is your responsibility to check this page regularly. Continued use of our services after updates constitutes your agreement to the revised terms.
