Terms and Conditions for Bulk SMS Solutions
Effective Date: 30-05-2025
1. Acceptance of Terms
By using services from Bulk SMS Solutions (“we,” “us,” or “our”), you (“User,” “Reseller,” or “Client”) agree to comply with these Terms & Conditions (T&C), TRAI’s Telecom Commercial Communication Customer Preference Regulations (TCCCPR), SEBI guidelines, and all applicable Indian laws.
2. User Obligations & Compliance
- DLT Registration: Users MUST register all SMS templates, sender IDs (6-character headers), and entities on the TRAI Distributed Ledger Technology (DLT) platform. Unregistered headers/templates will be blocked.
- Consent: Explicit, verifiable consent is mandatory for all promotional SMS. Transactional SMS (OTPs, alerts) require prior business relationships.
- Content Restrictions: Prohibited content includes:
- Unregistered loan/insurance/gambling offers (RBI/IRDAI compliance)
- Spam, phishing, or fraudulent material
- Political/religious content without election commission approval
- Content violating privacy (IT Act, 2000) or SEBI disclosure norms
- DND Compliance: Promotional SMS may ONLY be sent to non-DND registered numbers between 9 AM–9 PM IST.
3. Service Usage
- Transactional vs. Promotional Routes: Strict segregation as per TRAI. Misrouting incurs penalties.
- Sender ID Rules: Financial/OTP SMS must use SEBI/RBI-approved alphanumeric IDs (e.g., “BANKAB”).
- Blacklisted Keywords: SMS containing blacklisted keywords (e.g., “loan,” “lottery”) will be rejected.
4. Reseller Responsibilities
White-label resellers must:
- Ensure THEIR clients comply with TRAI DLT, consent, and content rules.
- Maintain audit trails of client consent for 6 months.
- Indemnify Bulk SMS Solutions against client violations.
5. Message Delivery & Liability
- We guarantee 99%+ deliverability but are NOT liable for:
- Network failures, operator issues, or incorrect numbers.
- User non-compliance leading to message rejection.
- TRAI-mandated delivery reports are final.
6. Data Security & Privacy
- User data is processed per our Privacy Policy and the Digital Personal Data Protection Act (DPDPA), 2023.
- SMS logs are retained for 6 months as per TRAI.
7. Payments & Refunds
- All fees are non-refundable for delivered SMS.
- Chargebacks incur 15% penalty.
- GST is applicable as per Indian law.
8. Termination
We may suspend/terminate accounts for:
- TRAI/SEBI violations
- Spam complaints or blacklisting
- Payment defaults
9. Amendments
T&C may be updated to reflect regulatory changes. Continued use implies acceptance.

11. Governing Law
These T&C are governed by Indian law. Disputes subject to jurisdiction in [Saharanpur, Uttar Pradesh] courts.
